Face ID brings new questions: Can the police force facial recognition to unlock the phone?

According to foreign media reports, after the iPhone X is launched in November, consumers who spend $999 will use a new feature: as soon as they look at the screen, the phone will be unlocked, and when they remove their eyes, the screen will Locked.

This feature, called Apple's Face ID, makes it easier to unlock your phone and saves users time. Apple said that iPhone users unlock their phones 80 times a day. But if unlocking the phone becomes too simple, the user may feel anxious.

At the press conference on Tuesday, Apple executives emphasized the security of Face ID. The mobile phone can recognize the face through a 3D image created by more than 30,000 infrared points projected onto the face. Then, as long as the user looks straight at the phone, the phone will be unlocked.

Phil Schiller, Apple's senior vice president of marketing, said at a press conference on Tuesday that it was impossible to deceive the technology with photos or masks, and that the information was stored in the security components of the device. The user can re-lock the phone by simply closing his eyes or looking elsewhere. Therefore, other people can't unlock the phone by waving the phone in front of the user.

Face ID may be advanced enough to avoid other people's mischief, but many people are curious, does this mean that the police can more easily unlock the suspect's phone. Can the police force the suspect to look at the phone and unlock the phone?

There is no simple answer to this question. A few years ago, when smartphones began to integrate fingerprint recognition technology, technologists had similar questions: Can the police ask suspects to scan their fingerprints to unlock their phones? The final answer is: It is possible. Since 2014, in several cases, US state and federal judges have signed search warrants that force fingerprints to be unlocked.

The provisions of the Fifth Amendment to the US Constitution provide that suspects have the right not to provide information that can convict them, such as passwords or cell phone PINs. However, fingerprints are not the information that is protected by the Constitution and that someone “masters”, but the characteristics of the human body itself. Similar to genes and handwriting, physical characteristics are generally considered to be unprotected by the Fifth Amendment to the US Constitution.

Despite the judge's decision, some jurists did not agree with the government's search warrant to force suspects to unlock biometric phones. Biometric technology relies on human physical characteristics. They believe that using physical features to unlock the device, the emergence of this function itself means that the law should be revised.

Last year, Albert Gidari, head of privacy research at the Stanford University Internet and Society Center, said: "When you put your fingerprint on your phone, you are actually doing some kind of communication. You Say to the phone, 'I am, please open.'" He believes that, like passwords, this form of communication should be protected by the Fifth Amendment to the US Constitution. The same approach applies to using physical features to unlock a phone, such as face recognition.

Whether the judiciary can legally allow someone to unlock their mobile phone is a matter that needs to be discussed openly until the relevant lawsuit appears. However, it seems that such uncertainty will not be the deciding factor for most people to buy the latest mobile phones, especially considering that many people are used to using fingerprints to unlock. (Decisive factors are more likely to be too high prices.)

In fact, Apple's most important adjustment to digital security is not from the latest flagship, but from the iOS11 system. Apple will launch this version of the system next week.

After this upgrade, the user can quickly click the power button 5 times to enter the emergency mode, you can choose to call the emergency phone, or display the medical ID, and also disable the fingerprint reader, only the password can be used to open the phone. (In the past, disabling the Touch ID required restarting the phone, or waiting for 48 hours.) It is unclear whether the emergency mode will disable the Face ID, but it is likely that this feature will also be implemented. Since the constitution protects passwords, 5 clicks on the power button allow iPhone users to avoid gray areas about biometrics.

Last week, Russian information security company Elcom Soft also found that in the new version of the system, when users connected the device to a computer, Apple added a simple step. In the past, users only needed to unlock the phone (can be unlocked by fingerprint) and click the “Trust” button to establish a connection. Currently, the user will be asked to enter their PIN or password. This again solves the problem of the gray area.

Nicholas Weaver, a computer security researcher at the Berkeley International Computer Science Institute, said the additional protection mechanism is particularly useful in US Customs border inspections. Border inspectors will check their equipment when they enter or leave the country. Usually they use the inspection software to copy the entire contents of the device to the computer, so that the keywords and contacts are thoroughly scanned.

However, at US Customs, the Fifth Amendment may not always be respected. The border inspectors are more willing to ask the passenger's mobile phone PIN code to bypass the iOS 11 protection mechanism.
